Terms of Service
Last updated September 28, 2026
These terms are an agreement between you and PhylaxNet (“we”) for the PhylaxNet app, website and service. By creating an account or using PhylaxNet you agree to them.
1. Using PhylaxNet
You may use PhylaxNet only on networks you own or are authorised to monitor and manage. Monitoring other people's networks or traffic without permission may be illegal. You're responsible for telling people who use your network that it is monitored where the law requires it (for example employees or guests).
2. Your account
Keep your password safe and tell us at support@phylaxnet.com if you think someone else has accessed your account. You're responsible for activity by you and the team members you invite.
3. Plans, trials and payment
New accounts get a free trial. Paid plans are billed monthly in advance through Stripe at the price shown when you buy; Business plans are priced per location (each office or home with a PC running PhylaxNet), and you're responsible for paying for every location you monitor. Beta access is free for as long as we run the beta; we'll give at least 30 days' notice before it ends. Subscriptions renew automatically until cancelled (Settings → Your plan → Manage billing); cancelling stops future charges and access continues until the end of the paid period. Except where the law requires otherwise, payments are non-refundable. We may change prices with at least 30 days' notice before your next renewal.
4. License
We grant you a personal, non-transferable licence to install and use the app on your own PCs for the plan you bought. Don't resell, reverse engineer (except where the law allows), or use PhylaxNet to attack, scan or disrupt networks you're not authorised to test.
5. What PhylaxNet can and can't do
PhylaxNet reduces risk; it does not make a network impossible to attack. It can miss threats, raise false alarms, and blocking or content filtering can be bypassed by a determined user. It is not a replacement for backups, antivirus, software updates or professional security advice. The cyber-insurance checklist helps you prepare and is not a promise that any insurer will offer or pay out on a policy.
6. Third-party components
The app relies on Npcap (installed separately under its own licence), Microsoft WebView2, and public threat-intelligence and blocklist feeds. We aren't responsible for those third parties.
7. Availability and changes
We work to keep the service available but don't guarantee it will be uninterrupted or error-free. We may add, change or remove features; if a change materially reduces a paid plan, you may cancel and ask for a prorated refund.
8. Disclaimer
PHYLAXNET IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.
9. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST DATA, PROFITS OR BUSINESS, ARISING FROM YOUR USE OF PHYLAXNET, INCLUDING SECURITY INCIDENTS IT DID NOT DETECT OR PREVENT. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not apply to you.
10. Ending
You can stop using PhylaxNet and delete your account at any time from Settings → Your data. We may suspend or close accounts that break these terms or put others at risk, and will tell you why unless the law prevents it.
11. Law
These terms are governed by the laws of the State of [your state], United States, without regard to conflict-of-law rules. Consumers keep any protections the law of their home country gives them.
12. Changes to these terms
We'll give account holders notice by email of material changes. Continuing to use PhylaxNet after they take effect means you accept them.
